The General Administration of Customs issued the “2015 China Customs Intellectual Property Protection Cases” on the 26th. Shenzhen Customs seized the top ten typical cases through the Guangdong-Hong Kong Customs Law Enforcement Cooperation Mechanism to seize counterfeit trademark mobile phone series.
As an international trade and shipping center, Hong Kong has always been coveted by the lawbreakers in the Mainland for its convenient trade and transshipment conditions. In this series of cases, since the first case was investigated, Shenzhen Customs was keenly aware of the risk of port drift of infringing goods such as mobile phones that were easily concealed by land transportation containers, and immediately reported to the General Administration of Customs and started the enforcement of Guangdong and Hong Kong Customs IPR enforcement The cooperation mechanism seized a series of major cases in one fell swoop, effectively curbing the passage of land transportation ports for infringing goods.
In January 2015, a trading company in Chongqing declared a batch of paper paper boxes, lampshades and other goods to Wenjindu Customs under Shenzhen Customs. The destination was Hong Kong. After inspection, Wenjindu Customs found that the declared goods were suspected of being oversubscribed and underexported, and 9493 mobile phones were hidden in the goods, involving 5 brands including IPHONE, SAMSUNG, BLACKBERRY, LG, and SONY. After identification, all the hidden mobile phones are counterfeit products.
In response to the case, the General Administration of Customs and the Hong Kong Customs immediately launched a law enforcement cooperation mechanism. In April 2015, 19196 mobile phones and accessories of counterfeit IPHONE and other brands were seized in Hong Kong, destroying several fake dens.
Shenzhen Customs carried out an in-depth analysis of the case, and believed that the routes to the key surveillance destination countries faced increasing monitoring pressure from the customs. It does not rule out the possibility that the criminals tried to export the infringing goods to Hong Kong first, and then use Hong Kong for re-export. Therefore, Shenzhen Customs has strengthened the monitoring of goods in land transportation ports in a targeted manner, and cooperated with Hong Kong Customs to carry out 'Guangdong-Hong Kong Customs Joint Law Enforcement Action', and successively seized 15 cases of mobile phone infringement at Wenjindu Port, detaining counterfeit mobile phones and their accessories 28,000 pieces, with a case value of more than 16 million yuan.
